Gabon Opposition Leader Stays in Jail as Court Throws out Appeal

Gabon's most prominent opposition figure isn't going home – a court has just rejected his bid for freedom, and his team says it's a dangerous sign for democracy.

Former Prime Minister Alain-Claude Bilie-By-Nze will remain in detention after the Libreville Court of Appeal on 2 June rejected his application to nullify the case against him. He's been locked up since 16 April.
The charges? Alleged breach of trust and fraud dating all the way back to 2008. His defence team argues the case is nonsense on a technicality, they say the allegations are statute-barred and shouldn't even be prosecuted now.
His lawyer, Arthur Vercken, didn't hold back. He called the continued detention a serious violation of Gabonese law, fair trial guarantees, and the country's international commitments, and demanded Bilie-By-Nze's immediate release.
His party, Ensemble pour le Gabon, claims the whole arrest was brutal and irregular. They allege he was held for 24 hours without a lawyer before he was formally charged.
President Brice Oligui Nguema, meanwhile, says he's got nothing to do with it. In an interview with France 24, he insisted Gabon's judiciary is independent: "I have nothing to do with it. It is a private matter," he said, adding that foreign observers are quick to question African courts while accepting separation of powers elsewhere.
It's worth remembering who Bilie-By-Nze is. He served as prime minister under Ali Bongo Ondimba and emerged as Oligui Nguema's toughest challenger in the 2025 presidential election, which he lost. His arrest came right after a string of very public criticisms – he slammed the government over its suspension of social media platforms and objected to nationality code reforms that were pushed through without parliamentary debate.
Supporters see this as a clear attempt to silence a critic. The authorities maintain it's purely a judicial matter.
With legal options narrowing and political tension rising, this case is fast becoming the big test of political freedoms and the rule of law in Gabon.
